The Board of Zoning Appeals is a quasi-judicial body consisting of five (5) members. Three (3) citizen members appointed by the Mayor of the City of who one must be a member of the Plan Commission and two must not be members of the Plan Commission. One (1) citizen member appointed by the City Council, who must not be a member of the Plan Commission. One (1) citizen member appointed by the Plan Commission who must be a member of the Plan Commission other than a member appointed by the Mayor. The members must reside in the judicial area and serve for a term of four (4) years. IC 36-7-4-902
The Board of Zoning Appeals carries out specific functions. The Board must uphold the meaning and spirit of the Ordinance as enacted by the governing body. If certain provisions consistently lead to injustice or hardship, the Board should recommend to the Plan Commission that the Ordinance be amended. The powers and duties of the Board are set forth in enabling legislation. In Crown Point, the Board’s functions fall under three major headings: 1. Appeals from Administrative Decision, 2. Recommend to Council special uses and variance of use and 3. Granting variances from Development Standards.
